Benue State House of Assembly today drew the attention of all
relevant authorities to threats made by the Miyetti Allah Kautal Hore Cattle
Rearers Association to attack Benue State.
The call was made by the House after accepting a motion of
urgent public importance by the Majority Leader of the House, Rt. Hon. B. T.
Adanyi. In his motion, Adanyi called on all relevant authorities to be aware
that "the Constitution of the Federal Republic of Nigeria 1999 (as
amended) endows the sole powers to make laws for Benue State with the Benue
State House of Assembly". In view of this, he cited Sections 4(6) and
(7)(a)that:
“(6) The legislative powers of a State of the Federation
shall be vested in the House of Assembly of the State.
(7) The House of Assembly of a State shall have powers to
make laws for the peace, order and good governance of the State or any part
thereof with respect to the following matters, that is to say—
(a)Any matter not included in the Exclusive Legislative List
set out in Part I of the Second Schedule to this Constitution.”
Mr. Adanyi further called on all relevant authorities to also
be aware that, "in line with Section 4(7)(a) of the Constitution, Section
1 of the Land Use Act Chapter 202 Laws of the Federation of Nigeria 1990 states
that:
1—Subject to the provisions of this Act, all land comprised
in the territory of each State in the Federation are hereby vested in the
Governor of that State and such land shall be held in trust and administered
for the use and common benefit of all Nigerians in accordance with the
provisions of this Act"
It was in the spirit and letters of those enabling Laws of
the land that the Governor of Benue State, His Excellency Samuel Ortom,
proposed the Open Grazing (Prohibition) and Establishment of Ranches Law, 2017
which was judiciously enacted by the Benue State House of Assembly, Adanyi
said.
Even with the foregoing constitutional rights given to Benue
people to make laws, Adanyi said it was saddened that since the enactment of
the said Open Grazing (Prohibition) Law and its assent by the Governor of Benue
State as empowered by Law, the leadership of Miyetti Allah Kautal Hore,
notably, its National President, Alhaji Abdullahi Bello Bodejo and its National
Secretary, Saleh Alhassan, have being making unguarded and provocative
statements, some of which amounted to doubting and undermining the authority of
Benue State House of Assembly and the entire Government of Benue State.
More worrying is that, some of these damning and provocative
utterances made by the leadership of Miyetti Allah Kautal Hore as variously
reported in National Dailies, Blogs and Social media, ultimately amount to a
declaration of war against the peaceful territory of Benue State and its
defenceless people, and that these publications have the potential of inciting
its members to commence attack on the helpless Benue citizens as the members of
Miyetti Allah Kautal Hore (cattle breeders association) are already known to be
marauding considering the carnage they have already wreaked on Benue State in
the recent past.
Adanyi said that despite the repeated cry and calls by the
Benue State Government and its peace loving and law abiding citizens, the
Federal Government of Nigeria and its security agencies has failed to apprehend
the said leadership of Miyetti Allah Kautal Hore, notably, Alhaji Abdullahi
Bello Bodejo (National President) and Saleh Alhassan (National Secretary) and
bring them to justice for their deliberate reckless and dangerous declarations
of hostilities against Benue State and its people, they have been left free.
This might lead every reasonable human being to conclude rightly that members
of Miyetti Allah Kautal Hore have been exploiting the advantage of having one
of them currently serving as the President and Commander-in-Ch ief of the
Armed Forces of the Federal Republic of Nigeria.
He said he hate to say the President could be fueling the
crisis, he said he even hate to think the president could do that because he
took oath to protect every member of the country. He mentioned also that he was
taken aback to read in a national daily that the leadership of the herdsmen
called on the President to call the Governor to order for daring to implement
the anti open grazing law, with this development, the silence of the President
is more worrying, therefore, not out of place to say that if further life is
lost in Benue State for the inability of the President to act proactively, he
will be held responsible. This message, we send to the entire world.
This motion was seconded by Rt. Hon. Ianna Jato and got the
general nod of all the members present
The House resolved to:
Draw the attention of the National Assembly, comprising the
Senate and House of Representatives of the Federal Republic of Nigeria to
the holocaust which Miyetti Allah Kautal Hore has promised Benue State by their
threat to occupy the whole of the State from November 2017 when the Open
Grazing (Prohibition) Law comes into effect, and onward.
Draw the attention of the United Nations system and the
entire Diplomatic Community, comprising of Embassies, High Commissions and
other diplomatic missions of friendly nations represented in Nigeria to the
holocaust which Miyetti Allah Kautal Hore has promised Benue State by their
threat to occupy the whole of the State from November 1st 2017 when the Open
Grazing (Prohibition) Law comes into effect, and onward.
Send a distress call to Houses of Assembly of neighbouring
States of Nasarawa, Kogi, Enugu, Ebonyi, Cross River and Taraba States
intimating them of the bloodbath members of Miyetti Allah Kautal Hore had
visited upon Benue State in recent years, and their reckless utterances in the
present circumstances; to urge them to be on guard and to assist in prevailing
on the National Assembly to rise to the challenge of saving Benue State and its
citizens from impending destruction.
Call on all relevant authorities to as a matter of urgency
arrest the leadership of the Miyetti Allah Kautal Hore Cattle Rearers
Association over their threats to attack Benue.
Call on the president to as a matter of urgency rise in
defense of the Benue people.
